The Supreme Court has repeatedly dismissed a lawsuit claiming that drug makers have taken Viagra and other impotence drugs without the knowledge of the Food and Drug Administration.
In December 2013, the Supreme Court in Washington, D. C., ruled that the FDA is not required to regulate prescription drugs. The Court upheld a lower Court finding that, despite the FDA’s warning, Viagra was an unapproved drug.
A 2013 ruling also dismissed another lawsuit, brought by the makers of Viagra, which sought to overturn the FDA’s finding that the drugs were not safe. A second suit, brought by the manufacturers of Cialis, Levitra and Stendra, also claimed that the FDA’s decision was “arbitrary and capricious”.
In July 2013, the Court granted a motion to dismiss for lack of standing. However, the Court also dismissed the plaintiff’s claim that the FDA was required to regulate the use of certain drugs.
On June 23, 2014, the Court of Appeals for the 4th Circuit in the case of Eli Lilly & Co. v. Valeant Pharmaceuticals USA. In that case, the 4th Circuit held that the FDA’s safety determination was “arbitrary and capricious,” and dismissed the plaintiff’s claim that the drug maker’s actions were “arbitrary and capricious”.
In the drug litigation, the 4th Circuit found that the FDA’s safety assessment was based on “the evidence provided by the Food and Drug Administration.” The FDA also noted that the drug’s label does not state that the drug is safe. The FDA did not address the FDA’s determination, however.
The 4th Circuit reversed, finding that the “in determining that the FDA’s findings are not against the preponderance of the evidence.” The 4th Circuit also found that the FDA’s failure to address this argument was “arbitrary and capricious.”
In the case of Eli Lilly & Co. Viatris, the Court found that the drug’s label did not provide the “in determining that the FDA’s findings are not against the preponderance of the evidence.” The viatris case was dismissed by the 4th Circuit in the viatris case, but the viatris case was dismissed in the viatris case.
